What Is North Carolina's Minimum Wage for Tipped Employees?

A tip credit lets an employer count part of an employee's tips toward the minimum wage, so it can pay a lower hourly wage as long as tips make up the difference.

North Carolina's minimum wage is $7.25 per hour, the same as the federal rate. Tipped employees can be paid $2.13 per hour, as long as tips bring them to at least $7.25. If they don't, the employer must make up the difference.¹

North Carolina adds a few requirements. To take a tip credit, an employer must:¹ ²

  • Tell employees about the tip credit in advance.
  • Let employees keep all their tips, apart from a valid tip pool.
  • Keep accurate records of tips each employee receives.
  • Have employees certify their tips monthly or each pay period.
  • Tips must be paid on the regular payday, including tips left by card.²

Who Owns Tips in North Carolina?

In North Carolina, an employer that takes a tip credit must let tipped employees keep all their tips, apart from a valid tip pool.² Federal law adds that employers, managers, and supervisors cannot keep any part of employees' tips.⁴

Are Tip Pools Allowed in North Carolina?

A tip pool is an arrangement where employees' tips are combined and shared among a group, such as servers, bussers, and bartenders.

Yes, with a limit most states don't have:¹ ²

  • Tipped employees only. Tips can be pooled among employees who customarily and regularly receive tips.
  • 15% cap. A tip pool can't reduce any employee's tips by more than 15%.
  • Records required. Employers must keep accurate records of pooled tips.
  • Managers and owners are out. Under federal law, managers, supervisors, and owners cannot take tips from the pool.⁴

North Carolina's Department of Labor enforces these rules mainly for businesses with less than $500,000 in yearly sales. Larger businesses also follow federal tip pool rules.¹

Are Service Charges Considered Tips in North Carolina?

No. North Carolina defines a tip as money above what's owed to the business.² Under federal law, a mandatory service charge, such as an automatic 18% added to a large party's bill, is not a tip.⁴

The business decides how to distribute a mandatory service charge, so check your bill before deciding whether to tip more.

Can Employers Take Credit Card Fees Out of Tips?

North Carolina's rules don't address this, so federal law applies. An employer that pays a percentage-based card fee can deduct that same percentage from a card tip, but nothing more.⁴
