What Is Delaware's Minimum Wage for Tipped Employees?
A tip credit lets an employer count part of an employee's tips toward the minimum wage, so it can pay a lower hourly wage as long as tips make up the difference.
Delaware's minimum wage is $15.00 per hour, effective January 1, 2025.¹ Tipped employees can be paid a cash wage of $2.23 per hour, as long as tips bring them to at least $15.00 per hour each week.¹
If tips fall short, the employer must pay the difference.³
Who Owns Tips in Delaware?
In Delaware, tips are the sole property of the employee who directly serves the customer. Employers cannot keep any part of them.² Managers and supervisors cannot receive employee tips, and tips cannot be used to cover business expenses.³ ⁵
Are Tip Pools Allowed in Delaware?
A tip pool is an arrangement where employees' tips are combined and shared among a group, such as servers, bussers, and bartenders.
Yes, but Delaware's rules are stricter than federal law:² ³
- Employees can set up their own pools. Workers can agree among themselves to share tips.
- Employer-required pools are limited. An employer can require a pool only when several employees serve the same customer. The pool can't take more than 15% of the server's tips.
- No pressure to join. Outside that situation, employers cannot require or pressure employees to share tips.
- Only tipped staff take part. Only employees who normally receive tips can share in a required pool, and the employer can never take a share.
- Written policies. Employers must put their tip policies in writing.
Are Service Charges Considered Tips in Delaware?
Not exactly, but Delaware protects them for workers. A service charge is a mandatory amount added to the bill. Unless the menu, a sign, or the bill clearly says that management keeps some or all of it, the service charge belongs to the employees who served the customer.²
If you see a service charge on your bill, check the menu or ask your server where it goes before deciding whether to tip more.
Can Employers Take Credit Card Fees Out of Tips?
Delaware's rules don't address this, so federal law applies. An employer that pays a percentage-based card fee can deduct that same percentage from a card tip, but nothing more.⁴
Tipping While Visiting Delaware
Delaware's beach towns, tax-free shopping, and Brandywine Valley attractions draw visitors from across the Mid-Atlantic, which creates tipping situations many haven't run into before.
Whether you're spending a week in Rehoboth Beach or a weekend in Wilmington, here are popular experiences where travelers often have questions about tipping.
Beaches and Outdoor Adventures
Beach Chair and Umbrella Service
Rehoboth, Dewey, and Bethany beaches have attendants who set up chairs and umbrellas each morning. Since the rental is paid in advance, visitors often wonder whether the attendant expects a tip.
